Terms & Conditions

These Terms and Conditions (“Terms”) govern the hire of luxury handbags and accessories from Posh Purse (“we”, “us”, “our”) by the customer (“you”, “hirer”). By placing an order, making a payment, or taking possession of any item, you agree to be bound by these Terms.

1. Eligibility

• You must be at least 18 years of age to hire from us.
• You must provide valid government-issued photo identification upon request.
• We reserve the right to refuse service at our discretion.
• An agreement to hire is formed once you accept these terms and conditions and make payment of the hire fee.

2. Hire Period

• The hire period begins on the delivery date or collection date and ends on the agreed return date.
• Late returns may incur additional fees as set out in clause 9.
• Early returns do not qualify for partial refunds.

3. Booking & Payment

• All bookings are subject to availability.
• Full payment of the hire fee and any required security bond must be made before dispatch or collection.
• Prices are listed in Australian Dollars (AUD) and include GST unless stated otherwise.
• Payment can be made by Visa or Mastercard.

4. Security Bond

• A refundable security bond may be required for each hire.
• The bond is used to cover loss, damage, excessive wear, cleaning, repair, or late return fees.
• Bonds are typically released within 5–10 business days after the item is returned and inspected, subject to deductions.

5. Use & Care of Items

You agree to:

• Use the item with due care and for its intended purpose only.
• Keep the item under your control at all times.
• Store the item safely away from direct sunlight, liquids, cosmetics, perfumes, and sharp objects.
• Not alter, repair, clean, or attempt to fix the item yourself.
• Not use the item in a manner that may cause damage, including but not limited to
  exposure to water, alcohol, oils, or smoke.

6. Prohibited Use

You must not:

• Use the item for illegal activities.
• Sub-hire, lend, sell, or transfer the item to any third party.
• Use the item while engaging in high-risk activities or environments.

7. Damage, Loss & Theft

• You are fully responsible for the item from the time of delivery/collection until it is returned and received by us.
• Any damage (including stains, scratches, odours, colour transfer, broken hardware, or structural damage) will be assessed by us.
• In the event of loss or irreparable damage, you agree to pay the full replacement value of the item (which may exceed the security bond).
• Theft must be reported to police immediately and

8. Fair Wear and Tear

• Minor wear consistent with normal careful use may be accepted at our discretion.
• What constitutes fair wear and tear is determined solely by us.

9. Return of Items

• Returns may be made in person by appointment at our office, or via pre-paid Australia Post Express Satchel.
• If an item is returned via Australia Post this must be lodged over the counter at an Australia Post store on or before the booking return date and you must provide us with the tracking number for the parcel.
• If your parcel is not received by us within the necessary time frame and no Australia Post tracking is provided, you will be liable for recovery fees.
• Late returns will incur a fee of up to $100.00 per day or part thereof. This fee will automatically be charged to the credit card used for your order.
• Continued late return may result in additional charges, including the full retail value if the item is not returned within 5 business days.
• By accepting this agreement, you give permission for Posh Purse to charge late fees to the payment method you used when placing your order.
• If we are unable to charge your credit card or otherwise collect payment from you, we will engage a debt collection service and you will be liable for all recovery fees.

10. Cleaning & Repairs

• Professional cleaning and repairs will be arranged by us only.
• Do not under any circumstances attempt to clean or repair the item yourself or have the item cleaned or repaired by any other person.
• Cleaning or repair costs resulting from misuse or excessive wear will be deducted from the bond or charged separately.

11. Cancellations

• Cancellations made 14 days or more before the hire start date may receive a refund or credit (less any admin fee).
• Cancellations within 14 days of the hire start date are non-refundable.
• No refunds are provided for change of mind.

12. Faults & Authenticity

• All items are guaranteed authentic.
• Items are hired in pre-loved condition unless stated otherwise.
• Minor imperfections may be present and do not constitute a fault.

13. Limitation of Liability

• To the maximum extent permitted by law, we are not liable for any indirect or consequential loss.
• Our liability is limited to the amount paid for the hire, except where the Australian Consumer Law applies.

14. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies conferred by the Australian Consumer Law (ACL) that cannot be excluded.

15. Privacy

• We collect and use personal information in accordance with the Privacy Act 1988 (Cth).
• Your personal details and credit card information will be stored on our secure data base.
• Posh Purse will not be liable for any breaches of security that occur externally on your device which cause a subsequent breach on your account with us.
• Posh Purse will provide your information to Australia Post for the purpose of delivering an item to you.
• Your information will be released to our insurer, debt collector and/or the Police in the event that you breach this hire agreement.

16. Termination

• We may terminate a hire immediately if these Terms are breached.
• Upon termination, the item must be returned immediately at your expense.

17. Governing Law

• These Terms are governed by the laws of New South Wales, Australia.
• You submit to the exclusive jurisdiction of the courts of NSW.

18. Amendments

• We may update these Terms from time to time.
• The Terms applicable at the time of booking will apply to your hire.

By proceeding with a booking, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
